This website is operated by LM Jewellers (formerly known as Luxe Moissanite; "LM Jewellers," "we," "us" or "our"). LM Jewellers offers this website, and all information, tools and services available on it, to you conditioned on your acceptance of these Terms of Service, our Refund, Returns & Exchange Policy, our Privacy Policy, and our Shipping Policy, all of which form part of your agreement with us.
By visiting our site and/or buying something from us, you agree to be bound by these Terms. If you don't agree, please don't use the site or place an order.
Nothing in these Terms limits, excludes or reduces any right you have under the Consumer Protection Act 68 of 2008 ("the CPA") or any other South African law. Where anything in these Terms conflicts with the CPA, the CPA applies. If any part of these Terms is found unenforceable, the rest remains in force.
Our store is hosted on Shopify Inc., who provide the e-commerce platform we sell through.
1. Using this site — You confirm you're at least the age of majority where you live, or have a parent/guardian's consent. You won't use the site unlawfully, or transmit viruses or malicious code. A serious breach may result in suspension of your access.
2. General conditions — We may refuse service to anyone, at our discretion, for legitimate business reasons — except on any unlawfully discriminatory basis. Card details are always encrypted. You won't reproduce, resell, or exploit site content without our written permission.
3. Accuracy of site information — Site content may occasionally be out of date. This is about website content only — it doesn't reduce your rights on the quality, description, or performance of anything you actually buy, which are covered by our Refund Policy and the CPA.
4. Prices and changes to the site — Prices are subject to change, but only for orders placed after the change — never retroactively to an order you've already placed and paid for.
5. Our products — We can't guarantee screen colour accuracy. We may limit quantities or discontinue a product, applied consistently. This section does not exclude or limit the CPA's implied warranty of quality on anything you buy (see Refund Policy Sections 5 and 5.1).
6. Your order and billing information — We may decline or limit an order (e.g. suspected fraud or duplicate submission) and will try to notify you. If we cancel a paid order for any reason on our side, you get a full refund within 7 business days. If we find a genuine pricing error after you've ordered, we'll contact you with the correct price first — you choose to proceed or cancel for a full refund; we never silently charge more. Returns/refunds/exchanges are governed by our Refund Policy, which takes precedence on that topic.
7. Third-party tools and links — Provided "as is," without endorsement; check their own terms.
8. Your comments and feedback — You agree we can use feedback you send us (e.g. in marketing) without compensation, and confirm it's lawful and your own.
9. Your personal information — Handled under our Privacy Policy.
10. Prohibited uses — No unlawful use, harassment, false information, malicious code, scraping, or interfering with site security.
11. Liability — We don't promise uninterrupted or error-free service. Nothing here excludes or limits: the CPA s56 implied warranty of quality; your s56(2) right to repair, replacement or refund; or our s61 liability for harm from unsafe/defective goods, or for death, injury, or property damage caused by our negligence. Where the law allows it, liability for indirect/consequential loss is limited to the value of your order.
12. Indemnity — If you breach these Terms or the law through your use of the site, you cover reasonable resulting costs. Doesn't apply to claims from our own negligence or breach.
13. Severability — An invalid clause is narrowed or removed; the rest stays in force.
14. Ending this agreement — You can stop using the site anytime. We may end access for serious breach, but this doesn't affect any order already paid for or any right that arose before that point.
15. Discount codes and promotions — Codes are valid only within their stated period. If applied after expiry, we contact you first — you choose to proceed at the correct price or cancel for a full refund. We never charge extra without your agreement.
16. Free-item offers — Specific terms stated with each offer, including claim window and exclusions.
17. Changes to these Terms — The current version is always on this page. Any order you place is governed by the version in effect on the date you placed it — a later change never applies retroactively to an order already underway.
18. Governing law and disputes — Governed by South African law. You may refer a dispute to the CGSO (www.cgso.org.za, free of charge), the National Consumer Commission, or a South African court, at any time.
